AloneAssist is not a medical alert system, emergency service, or substitute for professional medical care. If you believe someone needs immediate help, call 911.
Service Description
AloneAssist provides AI-powered daily wellness calls to older adults living alone. Our service is a supplemental informational technology service. It is not a substitute for medical care, in-person supervision, personal emergency response systems (PERS/medical alert devices), emergency services (911), or regular family check-ins. Summaries and mood scores generated after each call are approximations intended to keep family members informed — they are not medical assessments or diagnoses.
You acknowledge that AloneAssist is one component of a broader care plan and should never be the sole means of monitoring an older adult’s safety or well-being. AloneAssist does not have care, custody, or control over any subscriber.
AloneAssist Is Not an Insurer
AloneAssist is not an insurer. The monthly subscription fee reflects the cost of providing daily wellness calls and related notifications — it does not reflect the value of any property protected or the potential for harm to any person. You are responsible for maintaining appropriate insurance coverage, including health, life, and property insurance.
Acknowledgment of Service Limitations
By using AloneAssist, you acknowledge and accept that:
- Calls may fail due to phone line issues, carrier problems, voicemail interception, the subscriber’s phone being powered off, or technical errors in our systems.
- The service may experience outages, bugs, or delays that prevent calls from being placed or completed.
- The AI may fail to detect signs of distress, may misinterpret responses, or may generate inaccurate summaries.
- Alert notifications to Care Circle contacts may be delayed or fail due to SMS or email infrastructure issues.
- The service is not designed, intended, or warranted to function in life-threatening or emergency situations.
Artificial Intelligence Disclosure
AloneAssist uses artificial intelligence and machine learning technologies provided by third parties to conduct wellness calls, generate conversation summaries, assess mood, and detect potential concerns. You acknowledge and accept that:
- AI is not human judgment. The AI may misunderstand speech, miss context, fail to recognize sarcasm or distress, or interpret silence incorrectly.
- AI may hallucinate or fabricate. The AI may generate summaries that include information the subscriber did not actually say, or omit information that was said.
- AI may behave unexpectedly. Despite our testing, the AI may say inappropriate things, give incorrect information, or respond in ways we did not intend or anticipate.
- Mood scores are estimates. AI-generated mood assessments are statistical approximations and may be inaccurate. They should never be used as the basis for medical decisions.
- Distress detection is not reliable. The AI may fail to flag a subscriber who is in distress, or may flag a subscriber who is not. Neither outcome should be treated as a definitive safety assessment.
- Third-party AI providers may change. We may change the underlying AI models or providers at any time, which may affect conversation quality, accuracy, or behavior.
AloneAssist is not liable for any actions taken or not taken based on AI-generated content, including summaries, mood scores, distress flags, or any other AI output. You agree not to make medical, safety, or emergency decisions based solely on information provided by AloneAssist.
Subscription Terms
- Free trial: 14 days, no credit card required.
- Pricing: $14.99/month or $120/year after the trial ends.
- Auto-renewal: Subscriptions renew automatically at the end of each billing period unless canceled.
- Payments: Processed securely by Stripe.
Cancellation
You can cancel your subscription with one click from the Settings page. Cancellation takes effect at the end of the current billing period — you retain access until then. We do not issue partial refunds for unused time within a billing period.
Acceptable Use
- Each account supports one subscriber (the older adult receiving calls).
- You must provide accurate contact information for the subscriber and Care Circle contacts.
- You must have authorization to consent to automated outbound calls on behalf of the subscriber, as required by applicable law including the TCPA.
Disclaimer of Warranties
AloneAssist is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that calls will be successfully completed on any given day.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall AloneAssist, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of life, bodily injury, emotional distress, loss of data, or loss of profits, however caused and under any theory of liability, whether in contract, tort, or otherwise.
In no event shall AloneAssist’s total aggregate liability for all claims arising out of or related to the service exceed the greater of (a) the amounts paid by you to AloneAssist in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred dollars ($100).
These limitations apply to, but are not limited to:
- Missed calls due to carrier issues, the subscriber’s phone being off or unavailable, software bugs, or outages.
- Inaccurate summaries or mood scores generated by AI.
- Alert delivery delays caused by SMS or email infrastructure.
- Any harm resulting from reliance on AloneAssist as a safety or wellness solution.
Nothing in these terms excludes or limits liability for fraud, willful misconduct, or any liability that cannot be excluded under applicable law.
Force Majeure
AloneAssist shall not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to: natural disasters, pandemics, telecommunications or internet outages, carrier failures, power failures, government actions, or third-party service provider failures (including our voice AI, telephony, and cloud infrastructure providers).
Indemnification
You agree to indemnify, defend, and hold harmless AloneAssist, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service in violation of these Terms; (b) your provision of inaccurate information; or (c) any third-party claim arising from your enrollment of a subscriber without proper authorization.
Dispute Resolution & Arbitration
Informal resolution first. Before filing any formal proceeding, you agree to contact us at support@aloneassist.com and attempt to resolve the dispute informally for at least 30 days.
Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules. The arbitration shall be conducted in the county where AloneAssist is headquartered (currently California). AloneAssist will pay all JAMS filing and arbitration fees for claims under $10,000. You and AloneAssist each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
Small claims exception.Either party may bring an individual action in small claims court for disputes within the court’s jurisdictional limit.
30-day opt-out. You may opt out of this arbitration agreement by sending written notice to support@aloneassist.com within 30 days of first accepting these Terms. If you opt out, disputes will be resolved in the state or federal courts located in California.
Waiver of Jury Trial
To the extent permitted by law, you and AloneAssist each waive the right to a jury trial in any dispute arising out of or related to these Terms or the Service.
Data Handling
Your privacy matters. How we collect, use, and protect your data is governed by our Privacy Policy.
Changes to These Terms
We will provide at least 30 days’ notice via email before any material changes to these terms take effect. Continued use of AloneAssist after the effective date constitutes acceptance of the updated terms.
Governing Law & Venue
These terms are governed by the laws of the State of Delaware, without regard to its conflict of laws provisions. Any disputes not subject to arbitration shall be resolved exclusively in the state or federal courts located in California. Nothing in these terms limits any consumer protection rights that you may be entitled to under the laws of your state of residence.
